Withdrawal policy and model withdrawal form

Here you will find the statutory withdrawal policy and the model withdrawal form. The wording follows the official model of the EU Consumer Rights Directive (Directive 2011/83/EU, Annex I). It is also available in German; the version in the language in which you placed your order is the binding one.

The right of withdrawal is only available to consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (Section 13 of the German Civil Code, BGB). Orders placed by lodges acting as an association (e.g. a registered association, “eingetragener Verein”) or by traders are not consumer contracts.

The withdrawal policy for goods applies to orders of goods; the withdrawal policy for gift vouchers applies to orders of gift vouchers.

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. If you have ordered multiple goods in one order and they are delivered separately, the withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.

To exercise the right of withdrawal, you must inform us (VALOXX GmbH, Buch der Suche, Baluschekstraße 1, 01159 Dresden, Germany, phone: +49 173 5235060, email: info@buch-der-suche.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or email). You may use the attached model withdrawal form, but it is not obligatory.

You can also exercise your right of withdrawal online at https://neu.buch-der-suche.de/en/withdraw-from-contract (button “Withdraw from contract here”). If you use this online feature, we will send you an acknowledgement of receipt of the withdrawal on a durable medium (e.g. by email), including its content and the date and time of its submission, without undue delay.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us (VALOXX GmbH, Buch der Suche, Baluschekstraße 1, 01159 Dresden, Germany) without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion of the right of withdrawal

The right of withdrawal does not apply to contracts for the supply of goods which are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer (Section 312g(2) No. 1 BGB; Article 16(c) of Directive 2011/83/EU). In our shop, this applies to:

• “Personalisation for Masons”: the diary into which your personal documents (e.g. your lodge passport) are bound, including the personalisation itself;
• “Personalisation for Lodges”: all diaries embossed with the jewel (bijou) of your lodge, including the personalisation itself (embossing die).

For the “Diary of the Search – the Original” in the standard versions offered (language, cover, binding, embossing) and for “The Box”, the right of withdrawal applies without restriction. We point out the exclusion separately on the respective product page and in the order summary before you place your order.
